BELIEF

The belief is a quite intriguing thing that the human mind possesses. It is necessary to live because you don't need to have the facts or knowledge of everything on which you can base your actions. Belief comes into action when knowledge is lacking. To make it more religious, some people call it "faith". The science of belief is quite interesting.  First, understand the nature of "Belief" in contrast to "Fact". When we see Belief in contrast to Fact it reveals two meanings. The first meaning, which is mentioned in the first paragraph i.e. lack of knowledge of fact. But sometimes we also believe despite having knowledge of complete fact. This second meaning is quite difficult to understand, and one may be called as “mad” for having that kind of belief. The fact is the final conclusion. “This is a yellow car”. You know that this is car and you know that this colour is yellow. So, here, you do not need to have a belief. When you cannot see the colour ...

Justice

JUSTICE The foundation of the State is based on justice. The State (King) has a duty to ensure justice in society. The whole legal system is formed to ensure justice in society. In this blog, I will try to explain the meaning of the term "justice".   NYAYA The word "Nyaya" does not literally translate into Justice. If we read in the Nyaya Sutras of Mahrishi Gautam, we find that "Nyaya" means logic. It is the logic that helps us find the truth, serving as the connecting point or medium through which we discover it. However, in the legal system, justice is not solely about finding the truth. If it were, there would not be acquittals on the grounds of doubt. In our legal system, an accused person is acquitted if the prosecution cannot meet the burden of proof beyond a reasonable doubt.  The correct meaning of the word "Justice" in our legal system would be "a balance of rights and interests of the members of the society". In one aspect, i...

TODAY's HUMAN

INTRODUCTION Humans are exploring themselves since they have the intelligence to observe themselves. Yet, after thousands of years, they have not been successful. Humans, nowadays live life in their self-created zone of ignorance, impotency and so-called "happiness" and ignore and even criticise which goes against their zone. We are living beings, leaving aside humans. Living beings respond to their surroundings. But, we act like dead zombies- getting up at 7; leaving home at 9 for study and work; returning back at 5; intoxicating themselves and sleeping. Is their sympathy or empathy left inside us towards our surroundings; is their compassion left in us toward other beings who are suffering from starvation, disease, injustice, or pain. Not at all. WE ARE JUST DEAD ZOMBIES.  HOW & WHY Since our birth, we have been told that you need to earn your living. Nothing wrong with it. One should do Karma for his living. We are not just told this thing only, but that we need to ea...

Applicability of Probation of Offenders Act, 1958

The Probation of Offenders Act, 1958 is a reformative legislation which was enacted to reform convicts. There is one aspect of its applicability and that is this Act does not apply to the Statutes which are enacted later than this Act and mentions the minimum punishment. The Supreme Court in the case of  Superintendent, Central Excise v. Bahubali [i]   held that “ where there is a statute which bars the exercise of judicial discretion in matter of award of sentence, the Probation of Offenders Act will have no application or relevance. ” Later, the Supreme Court while giving more clarification on this issue held in the case of  State through S.P., New Delhi v. Ratan Lal Arora [ii]   that “  in cases where a specific enactment, enacted after the Probation Act prescribes a minimum sentence of imprisonment, the provisions of Probation Act cannot be invoked if the special Act contains any provision to enforce the same without reference to any other Act contain...

Knowledge but inaction

The situation comes when you have knowledge, but still, inaction is the major hurdle. This may have become a life pattern of some people. The car is perfect, and the tank is full. The only issue is the ignition. Introduction Some people face a situation when they know about the action to be performed but still will (not can’t) not do it. The reason behind this is not any justification- it is just what they do not want to do. The issue is with the ignition i.e. willingness. Later on, they also do not approve of this inaction. Solution The solution lies in their knowledge only. The action is performed on two bases: i) willingness and ii) habit. Willingness, here, refers to your awareness of the action-whether you are doing in pressure or fear. That fear or pressure creates the willingness of your mind to perform action. Second, some actions are performed even when you are not aware. This happens with those actions which you have performed so many times that it goes deep into your...

Mind

The mind is that weapon of humans, if not controlled will kill its user and if controlled will help you to win this world. To control this weapon, you need not challenge it, you just need to befriend and understand its nature. Introduction In Indian philosophy, you would often mention Chitta, Buddhi, Man( рдорди ) and Ahankar. Chitta is described as an energy plain- a neutral in which all these things happen. Man is the depository of all thoughts and provides different options to you. Buddhi is the intellect, which allows you to make decisions- a discriminatory [formal meaning] power which allows you to differentiate two things. Ahankar is the self which you recognise as yourself. In Indian philosophy, the roles of these things are described with the help of a chariot which is as follows: The horses of the chariot are senses. Reins are man. The charioteer is buddhi and you are the rider.   Mind The senses, described as horses, will be activated or work when they come into...

Action: Right or Wrong| Good or Evil

When every man starts following the spiritual path or suffers anything in life, one question arises: Is it wrong or right? Am I following the path of righteousness? These questions are natural. But, requires deep contemplation. The answer to these questions will decide your future actions.  ACTION The Universe is in the form of vibrations if you study quantum physics. So, one thing to keep in mind is that your every action or inaction counts. Your action or where you did not act is going to impact your surroundings. An action is just like throwing a stone in water. Stone creates ripples in water. These ripples return back. Same way your action returns back and is very dependent on the intensity of your action. That's why it is said your actions return to you. That's also why it is said that you should not take action against anyone else which you cannot bear for yourself.  GOOD or BAD Let's start with the most basic statement: No action is right or wrong in this Universe....
